These Terms of Use (“Terms”) govern your access to and use of the LendEDU websites, applications, member account features, content, tools, and related services (collectively, the “Services”) made available by LendEDU (“LendEDU,” “we,” “our,” or “us”).

By accessing or using the Services, you agree to these Terms, our Privacy Policy, and any additional terms or disclosures we present for specific features or promotions. If you do not agree, you may not use the Services.

1. Our Services

LendEDU provides online services relating to consumer finance, including educational content, editorial reviews, comparison tools, calculators, directories, advertising placements, affiliate links, and account-based experiences.

Our Services may include:

  • independent editorial content and reviews about financial products, services, and companies;
  • comparison tools, calculators, educational articles, rankings, and other informational resources;
  • advertising, sponsored placements, and affiliate links to third-party financial products and services;
  • a logged-in member experience that may allow eligible users to access credit scores, credit report information, monitoring alerts, identity-related notices, financial insights, and personalized product advertisements or recommendations; and
  • promotions, surveys, scholarship programs, user review features, and similar offerings, if and when made available.

Some parts of the Services may be supported by third-party service providers acting on our behalf, including certain white-labeled account-based features. We may add, remove, modify, suspend, or discontinue any part of the Services at any time, with or without notice, subject to applicable law.

2. Eligibility and U.S.-Only Use

The Services are intended only for residents of the United States. By using the Services, you represent and warrant that you reside in the United States and that your access to and use of the Services is lawful where you are located.

To create an account or use registered-member features, you must be at least 18 years old and capable of entering into a binding legal agreement. Certain features may require additional eligibility criteria, such as successful identity verification or a valid U.S. Social Security number.

We control and operate the Services from the United States. We make no representation that the Services are appropriate or available for use outside the United States, and we may limit access based on geography, residency, sanctions, or legal restrictions.

3. Editorial Content, Reviews, Advertising, and Affiliate Relationships

3.1 Independent Reviews and Editorial Content

LendEDU publishes editorial content and independent reviews of financial products, services, and companies. We are not paid to provide favorable reviews or ratings. Our opinions are our own and may be based on criteria we determine in our discretion.

3.2 Advertising and Affiliate Relationships

LendEDU may earn compensation when users click links, submit information, apply for products, open accounts, make purchases, or otherwise take action with or through third-party advertisers, affiliate partners, lead buyers, marketing partners, or financial providers. We may also receive compensation for traffic, leads, placements, impressions, or other marketing services.

This compensation may affect how, where, and whether products, providers, or offers appear on the Services, including their placement, order, or prominence. Not all products or providers are included in our content, tools, or marketplace experiences.

3.3 No Guarantee of Offers or Results

We do not guarantee that you will receive any particular offer, rate, term, approval, prequalification result, savings amount, or financial outcome from any third party referenced on the Services. All underwriting, pricing, eligibility, approval, and account decisions are made by the applicable third party.

4. Member Accounts and Registered Experience

4.1 Account Registration

Certain features of the Services require a member account. By registering for an account, you represent and warrant that:

  • you are registering only for yourself;
  • all information you provide is true, accurate, current, and complete;
  • you will keep your information updated;
  • you will maintain the confidentiality of your account credentials; and
  • you are responsible for all activity that occurs under your account.

You may not sell, transfer, assign, or share your account with anyone else. If you believe your account has been compromised or used without authorization, you must notify us promptly.

4.2 Identity Verification and Data Access

To provide account-based features, we and our service providers may collect, receive, verify, and maintain information relating to you, including identity verification information, device information, fraud-prevention information, and consumer-report-related data as permitted by law and described in our Privacy Policy.

Some registered-member features may be supported by third-party service providers acting on our behalf. In those cases, certain underlying information needed to operate the feature may be collected, hosted, or processed primarily by those providers rather than directly by LendEDU. LendEDU may receive limited outputs, account metadata, alerts, identifiers, and related information needed to administer, support, personalize, secure, and improve the Services.

By registering for and using the account-based Services, you authorize us to use this information to establish and maintain your account, verify your identity, prevent fraud, provide access to your account features, and improve the Services.

4.3 Credit Scores, Credit Reports, and Monitoring Features

If offered through the Services, access to credit scores, credit reports, monitoring alerts, identity-related notices, and similar content is provided for your personal, consumer, non-commercial use only.

The credit score, credit report, or other consumer information displayed through the Services may be obtained from one or more third-party providers or consumer reporting agencies, whether directly or through service providers supporting the feature on our behalf. The information shown through the Services may differ from information used by lenders, landlords, insurers, employers, or others because different data sources, bureau files, update timing, and scoring models may be used.

LendEDU does not represent that it is a consumer reporting agency solely because it displays or makes available information provided through these features.

We do not guarantee the completeness, accuracy, timeliness, or availability of any credit-related information, alerts, or monitoring features.

4.4 Personalized Advertising and Product Recommendations

As part of the registered experience, we may display advertisements, offers, or recommendations that may be tailored based on information associated with your account, your interactions with the Services, and other information described in our Privacy Policy.

Any such advertisements, recommendations, or product matches are provided for informational and marketing purposes only and do not constitute financial, legal, tax, or other professional advice.

4.5 Account Suspension and Termination

We may suspend, restrict, or terminate your account or access to registered-member features at any time, with or without notice, if we believe you have violated these Terms, provided inaccurate information, created risk or potential legal exposure for us or others, or if the Services are no longer operationally or commercially available.

By using the Services or creating an account, you consent to receive communications from us electronically, including by email, in-app messages, and, where separately authorized by you, text messages or push notifications. These communications may include account notices, security alerts, verification messages, service updates, promotional messages, newsletters, legal notices, and other information relating to the Services.

You may opt out of promotional communications by following the unsubscribe instructions in those communications, but you may not opt out of service-related, transactional, security, or legally required communications while you continue to use the relevant Services.

6. Informational Purposes Only; No Professional Advice

The Services are provided for informational, educational, and marketing purposes only. LendEDU is not a lender, broker, credit counselor, debt relief company, credit repair organization, investment adviser, financial adviser, tax adviser, legal adviser, or consumer reporting agency unless expressly stated otherwise for a specific service.

Nothing on the Services constitutes or should be interpreted as financial, investment, legal, tax, or credit advice, or as a recommendation tailored to your personal circumstances. You are solely responsible for evaluating whether any product, service, or strategy is right for you.

7. Estimates, Calculators, Ratings, and Other Tools

Any calculators, estimates, rankings, ratings, approval indicators, savings projections, or similar tools or outputs made available through the Services are illustrative only. They may rely on assumptions, limited data, proprietary methodologies, user inputs, or third-party information, and actual results may differ materially.

We do not guarantee that any estimate, score, ranking, rating, or projection is accurate, complete, reliable, or suitable for your circumstances.

The Services may include links to third-party websites, offers, applications, products, content, or services. Your dealings with an unaffiliated third party are generally solely between you and that third party.

We do not control, endorse, or assume responsibility for third-party content, products, services, decisions, terms, privacy practices, or conduct. If you choose to visit a third-party website or engage with a third-party provider, you do so at your own risk and should review that third party’s applicable terms, conditions, and privacy policy.

Some features made available through the Services may, however, be supported by service providers acting on LendEDU’s behalf as part of the LendEDU experience. Those provider-supported features are still part of the Services, even if certain underlying systems, data processing, or operational functions are handled by service providers.

9. Acceptable Use Restrictions

You agree not to:

  • use the Services for any unlawful, fraudulent, misleading, or abusive purpose;
  • use another person’s account, identity, or information without authorization;
  • attempt to obtain consumer report information under false pretenses or in violation of applicable law;
  • copy, reproduce, scrape, reverse engineer, decompile, disassemble, mirror, frame, or create derivative works from the Services except as permitted by law;
  • interfere with the operation, security, or integrity of the Services;
  • use bots, scripts, crawlers, or automated means to access the Services in an unauthorized manner;
  • post or transmit content that is unlawful, defamatory, infringing, deceptive, obscene, harassing, or otherwise objectionable; or
  • use the Services for commercial exploitation or competitive purposes without our prior written consent.

10. User Content, Reviews, and Feedback

If we permit users to submit reviews, comments, ratings, survey responses, testimonials, or other content (collectively, “User Content”), you remain solely responsible for the User Content you provide.

By submitting User Content, you represent and warrant that you own or control all necessary rights in the User Content and that the User Content does not violate applicable law or the rights of any third party.

By submitting User Content, you grant LendEDU a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, host, store, reproduce, modify, adapt, publish, distribute, display, perform, create derivative works from, and otherwise exploit that User Content in connection with the Services and our business, including for marketing and promotional purposes.

If you provide us with suggestions, ideas, or other feedback, you grant us the right to use that feedback without restriction or compensation to you.

11. Intellectual Property Rights

The Services and all content, software, text, graphics, designs, logos, compilations, and other materials made available by us (collectively, “LendEDU Content”) are owned by LendEDU or its licensors and are protected by intellectual property and other applicable laws.

Except for the limited right to use the Services for their intended purpose, nothing in these Terms grants you any right, title, or interest in or to the Services or LendEDU Content. You may not copy, modify, distribute, republish, publicly display, publicly perform, transmit, sell, license, or otherwise exploit any LendEDU Content without our prior written consent, except as expressly permitted by law.

13. Privacy

Our collection, use, disclosure, and retention of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference.

The Privacy Policy also describes the distinction between information LendEDU collects or stores directly and information that may be processed by service providers supporting certain white-labeled or account-based features on our behalf.

Because the account-based Services may involve sensitive financial or consumer-report information, you should review the Privacy Policy carefully before creating an account or using those features.

14. Monitoring, Security, and Fraud Prevention

We may monitor, review, preserve, access, and disclose information relating to your use of the Services as reasonably necessary to operate the Services, authenticate users, prevent fraud, investigate suspected misconduct, comply with law, enforce these Terms, or protect our rights, property, users, service providers, or the public.

15. Disclaimers

THE SERVICES, INCLUDING ALL CONTENT, REVIEWS, CREDIT-RELATED INFORMATION, SCORES, REPORTS, ALERTS, TOOLS, ESTIMATES, USER CONTENT, ADVERTISEMENTS, AND THIRD-PARTY MATERIALS, ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LENDEDU DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT, AS WELL AS ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, LENDEDU DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY INFORMATION, OFFER, REVIEW, CREDIT SCORE, CREDIT REPORT, ALERT, ESTIMATE, OR RECOMMENDATION WILL BE ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR YOUR NEEDS.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LENDEDU AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF LENDEDU AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100), UNLESS A GREATER AMOUNT IS REQUIRED BY APPLICABLE LAW.

17. Indemnification

You agree to defend, indemnify, and hold harmless LendEDU and its affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, judgments, awards, costs, expenses, and fees (including reasonable attorneys’ fees) arising out of or relating to:

  • your use of the Services;
  • your violation of these Terms;
  • your violation of applicable law;
  • your infringement or alleged infringement of any intellectual property, privacy, publicity, or other rights of a third party; or
  • any User Content or information you submit through the Services.

18. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

18.1 Agreement to Arbitrate

Except for the limited exceptions described below, you and LendEDU agree that any dispute, claim, or controversy arising out of or relating to the Services or these Terms will be resolved by final and binding arbitration on an individual basis, rather than in court.

This arbitration agreement is governed by the Federal Arbitration Act.

18.2 Informal Resolution First

Before either party initiates arbitration, that party must send the other a written notice describing the dispute and the requested relief. The parties agree to attempt to resolve the dispute informally for at least 30 days before starting arbitration.

18.3 Arbitration Rules

Any arbitration will be administered by the American Arbitration Association (“AAA”) under its applicable consumer arbitration rules then in effect, unless the parties agree otherwise. The AAA rules and forms are available from the AAA.

18.4 Exceptions

Nothing in this section prevents either party from:

  • bringing an individual action in small claims court, if it qualifies;
  • seeking injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information; or
  • reporting issues to a governmental or regulatory authority where permitted by law.

18.5 Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND LENDEDU AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

18.6 Jury Trial Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IF A DISPUTE PROCEEDS IN COURT RATHER THAN ARBITRATION, YOU AND LENDEDU EACH WAIVE THE RIGHT TO A JURY TRIAL.

18.7 Severability of Arbitration Terms

If any portion of this arbitration section is found unenforceable, the unenforceable portion will be severed and the remainder will remain in effect, except that if the class action waiver is held unenforceable as to a particular claim, then that claim may proceed in court to the extent required by law.

19. Governing Law

These Terms and any dispute arising out of or relating to these Terms or the Services will be governed by the laws of the State of North Carolina, without regard to conflict of laws principles, except to the extent superseded by federal law, including the Federal Arbitration Act.

20. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we may provide notice by posting the updated Terms on the Services, by email, through your account, or by other reasonable means. Your continued use of the Services after updated Terms become effective constitutes your acceptance of the revised Terms.

21. Suspension, Deactivation, and Termination

These Terms remain in effect until terminated by either you or LendEDU. You may stop using the Services at any time, and you may deactivate your account if that option is made available through the Services.

We may suspend or terminate your access to all or part of the Services at any time, with or without notice, for any reason permitted by law, including if we believe you violated these Terms or if we discontinue the Services.

Sections that by their nature should survive termination will survive, including sections relating to ownership, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law.

22. Miscellaneous

These Terms, together with the Privacy Policy and any additional terms applicable to specific Services, constitute the entire agreement between you and LendEDU regarding the Services and supersede prior agreements relating to the same subject matter.

If any provision of these Terms is held unlawful, invalid, or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets, or by operation of law.
